Since January 2026 general AI assistants are banned on the WhatsApp Business API, task-specific ones are allowed. What that means, what it costs and when to switch.

In the Netherlands customer contact runs through WhatsApp. Not through a ticketing system, not through a portal, but through the same green icon people use to message their family. For businesses that is both a gift and a problem: the threshold is low, so message volume climbs, and customers expect a reply within minutes.

An AI assistant on WhatsApp solves that. But the rules changed on two points in 2026, and missing them can mean a blocked account or a fine.

Change 1: no more general AI assistants

Since January 2026 Meta no longer allows general-purpose AI assistants on the WhatsApp Business API. An assistant that will talk about anything, like a general chatbot, is out. Task-oriented business assistants remain perfectly allowed.

That sounds more threatening than it is. For smaller businesses little changes in practice, because the useful applications are precisely the task-oriented ones:

  • A dental practice confirming and rescheduling appointments
  • A webshop sharing the status of an order
  • An installer automatically messaging back after a missed call
  • A salon offering a waiting-list slot when someone cancels

So the line runs along purpose: if you help customers with your own service, you are fine. If you offer a kind of general chatbot through WhatsApp, you are not.

Change 2: the assistant has to say it is AI

Since 2 August 2026 the EU AI Act requires that people know when they are talking to an AI system. That applies on WhatsApp too. One line at the start of the conversation is enough, and in practice such a line increases trust when you immediately add that a human is available.

What does business WhatsApp cost?

Meta charges per conversation, not per message. For businesses in the Netherlands, service conversations, where the customer starts, run around 4 to 6 cents in 2026. Marketing conversations, where you start, run around 8 to 12 cents.

That means conversation costs are negligible for most small businesses compared to the time saved. A thousand service conversations a month costs you roughly 40 to 60 euro in Meta fees.

When do you move to the Business API?

The regular WhatsApp Business app is fine as long as you can keep up by hand. Our rule of thumb: around a thousand customer interactions a month the move to the API becomes worthwhile. Below that it usually is not yet an investment worth making.

Other signals that it is time: several colleagues sharing one phone, messages sitting unanswered in the evening, or customers having to explain themselves twice.

How much does the assistant handle itself?

A well configured assistant typically answers 70 to 80 percent of routine questions on its own: opening hours, order status, availability, return policy, frequently asked questions. The remaining 20 to 30 percent goes to a human, and that is exactly how it should be.

The goal is not for the assistant to do everything. The goal is that you only handle the conversations that actually matter.

Where it goes wrong

  • No way out to a human. Customers get furious at an assistant they cannot escape.
  • Trying to do too much. Start with the ten most common questions, expand later.
  • No handover of context. If the customer has to repeat their story once a human takes over, the gain is gone.
  • Forgetting the notice. Since August 2026 that is not just impolite but against the rules.

The practical order

Start small and measurable. Collect every incoming question for a week. Count which ten come up most. Let the assistant handle exactly those ten, with a clear handover to a human. Then measure how many conversations it completes on its own, and only expand once that number holds up.
